1. Introduction and Acceptance of Terms

Welcome to Ankra! These Terms of Service ("Terms") govern your access to and use of the Ankra mobile application and web service (collectively, the "Service"), operated by Bahamapps AB ("we," "us," or "our").

By downloading, installing, accessing, or using Ankra, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Important: These Terms include important information about your legal rights, remedies, and obligations, including limitations on liability and binding arbitration of disputes.

2. Eligibility and Age Requirements

You must be at least 16 years old to use Ankra. By using the Service, you represent and warrant that you meet this age requirement.

If you are under 18 years old, you confirm that you have obtained permission from your parent or legal guardian to use the Service.

3. Account Registration and Security

3.1 Account Types

When you first use Ankra, we automatically create an anonymous account for you. You may optionally link your anonymous account to:

• Google account
• Apple account

3.2 Account Security

You are responsible for:

• Maintaining the security of your device
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Information

If you link your account to Google or Apple:

• You must provide accurate and complete information
• You must keep your account information up to date
• You may not impersonate any other person or use a false identity

4. Service Description

Ankra is a flashcard-based learning application that uses spaced repetition algorithms to optimize your study sessions. The Service includes:

• Flashcard Creation: Create, edit, and organize digital flashcards
• Study Sessions: Review cards using spaced repetition scheduling
• AI-Powered Generation: Generate flashcards from text prompts or uploaded images (requires linked account)
• Progress Tracking: Monitor your learning statistics and streaks
• Pre-made Decks: Access curated flashcard collections
• Rich Media Support: Add images, audio, and LaTeX mathematical notation to cards

5. Subscriptions and Payments

5.1 Subscription Plans

Ankra offers both free and premium subscription plans:

• Free Plan: Basic flashcard creation and study features
• Premium Plans: Additional features including AI-powered card generation, advanced statistics, and unlimited decks

Subscription details, pricing, and features are displayed in the app and may be updated from time to time.

5.2 Billing and Payment

• All payments are processed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your Apple App Store or Google Play Store account settings

5.3 Payment Processing

We use RevenueCat to manage subscriptions. Payment processing is handled by:

• Apple Inc. (for iOS users)
• Google LLC (for Android users)

We do not store or process your payment card information directly.

5.4 Refunds

Refunds are subject to the refund policies of Apple App Store and Google Play Store:

We may change subscription prices at any time. Price changes will:

• Take effect at your next renewal
• Give you the opportunity to cancel before the new price takes effect

6. AI-Powered Content Generation

6.1 AI Service Description

Premium subscribers can use AI-powered features to generate flashcards from:

• Text prompts describing topics or learning goals
• Uploaded images (photos of textbooks, notes, documents)

We use Anthropic's Claude AI to generate flashcard content based on your inputs.

6.2 Acceptable Use of AI Features

You may use AI generation features for legitimate educational purposes, including:

• Creating study materials for personal learning
• Generating flashcards from your own notes or textbooks
• Creating practice questions for exam preparation

6.3 Prohibited Uses of AI Features

You may NOT use AI generation features to:

Illegal Content:

• Generate content that violates any applicable laws or regulations
• Create content that infringes on intellectual property rights of others
• Produce content that violates copyright, trademark, or patent laws

Harmful Content:

• Generate content that promotes violence, terrorism, or harm to others
• Create content that is abusive, harassing, threatening, or discriminatory
• Produce content that exploits or harms minors

Academic Dishonesty:

• Generate content to complete assignments or exams that you are required to complete independently
• Create content that violates your institution's academic integrity policies
• Use AI features to bypass honor code requirements

Spam and Abuse:

• Generate large volumes of low-quality content
• Create content for resale or commercial distribution without permission
• Abuse the service through excessive API calls or automated usage

Misinformation:

• Intentionally generate false, misleading, or deceptive content
• Create content designed to spread misinformation or propaganda

6.4 Content Accuracy

AI-generated content is provided "as-is" without guarantees of accuracy, completeness, or reliability. You are responsible for:

• Verifying the accuracy of AI-generated flashcards
• Reviewing content before relying on it for learning
• Not using AI-generated content as a substitute for authoritative sources

We are not liable for any inaccuracies, errors, or omissions in AI-generated content.

6.5 Content Monitoring and Moderation

We reserve the right to:

• Review and moderate AI-generated content for policy compliance
• Implement automated systems to detect abuse
• Suspend or terminate accounts that violate acceptable use policies
• Report illegal activity to appropriate authorities as required by law

6.6 Fair Use & Generation Limits

To ensure high-quality service and AI availability for all students, Ankra monthly subscriptions include a generous "Fair Use" allowance of 30 AI-powered deck generations per month.

What counts as a generation?

Any request to create a new deck or auto-generate cards for an existing deck using our AI models counts as one generation.

What does NOT count?

Manual card creation, editing, and studying are always unlimited and do not consume generation credits.

What happens if I hit the limit?

You can continue to study, create cards manually, and use all non-AI features of the app. Your AI generation allowance will reset on your next billing date.

We reserve the right to adjust generation limits at our discretion. Any changes will be communicated in advance and reflected in the app.

7. User-Generated Content

7.1 Your Content

You retain ownership of all flashcards, decks, and other content you create ("Your Content"). By using the Service, you grant us a limited license to:

• Store and display Your Content within your account
• Process Your Content to provide the Service (e.g., spaced repetition scheduling)
• Back up Your Content for data recovery purposes

7.2 Content Responsibility

You are solely responsible for Your Content. You represent and warrant that:

• You own or have the necessary rights to Your Content
• Your Content does not violate any third-party rights
• Your Content complies with these Terms and applicable laws

7.3 Prohibited Content

You may not create or store content that:

• Violates any applicable laws or regulations
• Infringes intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is abusive, harassing, threatening, or discriminatory
• Exploits or harms minors
• Violates the privacy rights of others

8. Intellectual Property Rights

8.1 Ankra Intellectual Property

The Service, including all software, designs, graphics, user interface, trademarks, logos, and other content provided by us (excluding Your Content) is owned by Bahamapps AB and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or reverse engineer the Service
• Use our trademarks or branding without written permission
• Remove or alter any proprietary notices

8.2 License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, non-commercial purposes
• Create and store flashcards for your own learning
• Use premium features included in your subscription plan

This license does not permit:

• Commercial use without our written consent
• Resale or redistribution of the Service
• Use of automated systems or bots
• Reverse engineering or decompiling

9. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will meet your requirements or expectations
• AI-generated content will be accurate, complete, or reliable
• The Service will help you achieve specific learning outcomes
• Your data will be preserved indefinitely

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAHAMAPPS AB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100.

10.3 Consumer Rights

Nothing in these Terms limits your statutory rights under EU consumer protection laws.

11. Educational Disclaimer

Ankra is a learning tool and study aid. It is NOT professional educational advice or a substitute for formal education or instruction.

You are solely responsible for:

• Verifying the accuracy of flashcard content
• Meeting your educational institution's requirements
• Complying with academic integrity policies
• Achieving your learning goals

We make no guarantees about exam performance, grades, memory retention, or learning outcomes.

12. Termination

12.1 Termination by You

You may terminate these Terms at any time by:

• Uninstalling the app from your device
• Deleting your account through app settings
• Canceling your subscription through Apple App Store or Google Play Store

12.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or abuse AI generation features.

12.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases and your data may be permanently deleted.

13. Governing Law and Disputes

These Terms are governed by the laws of Sweden. As an EU user, you also benefit from mandatory provisions of the law of your country of residence.
